How to create your own real estate contract:

1. Draft Offer Contract

The Buyer starts an offer with the Mako smart survey. The smart survey asks
questions in a seamless, modern and automated format; instantly producing entries to corresponding Texas Real Estate Commission (TREC) forms.

2. Review with AI Guidance

Confidently write a contract without paying a Buyer Agent. While the value of Mako is writing a real estate offer contract on your own, you have access to our AI Shark Tips to easily understand detailed contract topics.

3. E-Sign

The buyers and sellers can instantly and securely execute the offer contract in the industry’s quickest format. Mako Contracts' e-signed documents are certified electronic signatures that cannot be edited once signed. Once executed, the listing agent can instantly sign the contract to execute the effective date.

4. Submit Offer to Listing Agent

Our system syncs with most Texas MLS listings, so that you can click to submit your offer directly to a Listing Agent. The Buyer can invite the Listing Agent and seller to a transaction for free access, to streamline negotiations on one platform. The Listing Agent must create a free account to login and use the features of Mako for the specific transaction. Here, everyone can review, sign and share the offer. Alternatively, the Buyer can simply share or download the PDF contract.

5. Share and Store

Our Smart Survey and corresponding PDF contract documents are automatically emailed as a secure, convenient link to invited users at the key stages of the deal. All transaction documents can be shared with any party, at any time.

FAQ

Can I really create my own offer contract without a Realtor?

Yes! It is legal and quite common to represent yourself in a real estate transaction. The Texas Real Estate Commission (TREC) provides forms for use by the public. Mako Contracts utilizes TREC forms to help Buyers easily understand the legal language and real estate purchase process. Mako Contracts is recommended for both first time homebuyers and experienced homebuyers who do not want to pay a large commission to Buyer Agents.

Can Mako provide advice on building the contract?

Our support team cannot provide advice to brokers, agents, buyers or sellers. Mako Contracts is a software as a service (SaaS) company and not a real estate brokerage. We empower people to be more effective with our software. Our friendly team can always help with technical or account support.

How do you charge a fee?

We allow Buyer users to enjoy the contract drafting process for free. If you want to e-sign or download the PDF contract, we charge a small fee per transaction. You can invite a second Buyer, such as a spouse to the transaction for free. Likewise, you can also invite a Listing Agent and two Sellers to the transaction for free.

Once I build a contract, can I share it with whomever I want?

Yes! As the Buyer, you can invite the listing agent and the sellers to review and execute the contract in a centralized place, for free. However, if you prefer to only build your contract with Mako, you can easily download or share the PDF contract documents at any time, with whomever you want.

Do you offer a free trial?

Buyers can sign up for free and create an entire contract for free. We charge a fee per transaction once you want to e-sign or download the contract. Buyers can invite other parties such as the Listing Agent and Seller to any transaction for free.

Agents can subscribe monthly and try our listing offer platform free for 7 days. If agents are invited to an existing transaction, it is always free.

What does the MLS integration do?

The MLS integration speeds up the contract to accurately populate time consuming contract fields such as: Listing Broker/Agent info, address, legal description, HOA info and more.

Are TAR forms available?

We are a pre-approved TAR Form Vendor with plans to implement Texas Associate of Realtor forms soon! We currently integrate with Texas TREC forms and your custom uploaded forms.

Can I upload my own documents to a transaction?

Yes! Our smart platform produces Texas TREC PDF forms through a survey format. However, you can upload any external PDF’s specific for your transaction to e-sign, review and store.

Can I draft a contract without being a broker or agent?

Yes! It is not a legal requirement in Texas to be represented by a real estate broker or agent. Many Buyers represent themselves in real estate transactions every day.

What types of contracts can I draft with Mako?

Users can create the two following Texas residential sales contracts: 1-4 Family Resale, and Condo Resale.  This means single family homes, condos and multiplexes with less than 4 units, which are being resold integrate with Mako.  Land, new construction and other property types are coming soon!

Do I need training to use with Mako?

We created Mako Contracts to be an intuitive and easy-to-use smart platform so users can get started writing an offer at any moment. We do not require training or time consuming onboarding. However, if you have any questions, our support team is available to help quickly!

What if I made a mistake and want to edit my offer after submitting it?

If your offer has not been accepted by a Seller or Listing Agent, then you can instantly withdraw your offer to easily edit terms or other information. All parties will be notified of a withdrawn offer and then again when you resubmit your new offer. If you want to change the property address after submitting an offer, please contact our Support Team.

Note, once your offer is accepted you cannot necessarily withdraw it, as there is a legal process to terminating an offer for purchase contract in Texas. Learn more with our Shark Tips and AI guidance once you sign-up.

Do you integrate with other real estate software?

We currently do not integrate with other real estate apps. We are an independent SaaS platform with new third party integrations coming soon! You can quickly export any transaction to upload to your other CRM systems, or use Mako to store all your transactions securely in our cloud.
